Terms and Conditions

These Terms and Conditions (“Terms”) apply to all bookings made with The Tumble Co (“we”, “our”, “us”) for the hire of soft play equipment. By placing a booking, paying a deposit or invoice, or using our equipment, you agree to be bound by these Terms.

1. Bookings & Payment

  • Booking Confirmation: A booking is confirmed once we receive a deposit of $200 or full payment (as advised).
  • Remaining Balance: The remaining balance is due no later than 7 days before the event date. If the balance is not paid within the specified period, we reserve the right to cancel the booking, and any payments made may be forfeited.
  • Unconfirmed Bookings: We reserve the right to cancel unconfirmed bookings or bookings with overdue payments.

2. Cancellations & Refunds

  • By You:
    • More than 13 days’ notice: A full refund of your payment will be issued, including the deposit.
    • Between 13 and 4 days’ notice: The deposit will be retained, but all other payments will be refunded.
    • Less than 4 days’ notice: Unfortunately, we are unable to offer a refund for any of the hire fees. However, the security bond will be refunded in full.
  • By Us: We may cancel your booking due to severe weather, safety concerns, or unforeseen equipment issues. In such cases, we will offer either a full refund or an alternative date based on your preference.

3. Delivery & Setup

  • Delivery & Setup: We will deliver, set up, and collect the equipment at the time and location agreed in your quote.
  • Access & Setup Space: Please ensure clear, level access to the setup area. Additional charges may apply for stairs, tight access, or long carries. It is your responsibility to ensure the setup space is safe, flat, and free from hazards. We reserve the right to cancel any booking if the setup location is unsafe, unsuitable, or does not meet these requirements.
  • Charges for Setup Changes: If the setup space is not as outlined in the quote, we reserve the right to charge additional fees. These will be invoiced immediately, and payment will be required within 3 business days.

4. Use of Equipment

  • Supervision: Adult supervision is required at all times while the equipment is in use.
  • Age Limit: Equipment is suitable for children aged 6 years and under.
  • Prohibited Items & Actions:
    • No shoes, food, drinks, face paint, glitter, pets, or sharp objects on the equipment.
    • Do not move, dismantle, or reposition the equipment once set up.
    • No smoking, alcohol, or fire sources near the play area.
    • No acrobatics or gymnastics on the soft play equipment.
    • No sick or unwell children are allowed within the play area, and/or on soft paly equipment.
    • Hirers are liable for any damage caused through misuse, neglect, or failure to supervise.

5. Cleaning & Damage

  • Cleaning Responsibility: Our equipment is cleaned and sanitised before every hire. You are responsible for returning the equipment in a clean and tidy condition.
  • Cleaning Fees: If excessive dirt, food, or mess is left, a cleaning fee of $50 may apply, which will be deducted from your security bond.
  • Damage Fees: Any lost or damaged items must be paid for at full replacement value. This includes damage caused by misuse or failure to follow the guidelines.

6. Safety & Liability

  • Safety: While we take every care to provide safe, high-quality equipment, you are responsible for ensuring safe use during the hire period.
  • Indemnity: You agree to indemnify us against any claims, injuries, losses, or damages arising from the use of the equipment, except where caused by our own negligence.
  • Insurance: We hold public liability insurance. However, we strongly recommend you obtain your own event or liability insurance, particularly for larger gatherings.

7. Risk & Responsibility

  • Property Rights: The equipment remains our property at all times.
  • Responsibility Transfer: Responsibility for the equipment passes to you upon delivery and ends once it is collected by us.
  • Unauthorised Use: You must not sub-hire, lend, or allow unauthorised use of the equipment.

8. Force Majeure

  • We are not liable for delays or cancellations due to events beyond our control, including extreme weather, road closures, natural disasters, or illness.
  • If a force majeure event occurs, we will notify you as soon as possible and work with you to reschedule, or provide a refund.

9. Privacy

  • We respect your privacy. Any personal details you provide will be used solely for booking and administrative purposes, in accordance with our Privacy Policy.

10. Agreement

  • By paying the deposit, you confirm you have read, understood, and agree to these Terms and Conditions. These Terms form a legally binding agreement between you and The Tumble Co.
